These Terms & Conditions govern sales made through the Yves Jaget website to both consumers and professional customers.

By placing an order, the customer acknowledges having read and accepted these Terms & Conditions.

2. Products

Yves Jaget microphones are handcrafted audio instruments manufactured in small batches.

The essential characteristics of each product are presented on its respective product page.

Photographs are intended to represent the products as faithfully as possible. Due to the handcrafted nature of the products, minor variations in finish or appearance may occur without affecting their function or performance.

MIX A L'EAU DE MER reserves the right to modify or discontinue products as part of the continuing development of the Yves Jaget range.

3. Prices and VAT

Prices are displayed in euros (€).

Prices shown on product pages are stated excluding VAT unless otherwise indicated. Where VAT is applicable, it is calculated and displayed during checkout according to the destination and applicable tax rules.

Shipping costs are not included in the product price and are displayed before the customer confirms the order.

For deliveries outside the European Union, local taxes, customs duties, import charges or other fees may apply. Where such charges are not collected at checkout, they remain the responsibility of the customer.

4. Orders

Orders are placed through the online store.

Before confirming an order, the customer has the opportunity to review the selected products, options, quantities, delivery information and total price and to correct any errors.

An order becomes binding once it has been confirmed and payment has been successfully completed.

An order confirmation is sent electronically to the customer.

MIX A L'EAU DE MER reserves the right to refuse or cancel an order in the event of a payment issue, manifest pricing error, product unavailability, suspected fraud or other legitimate reason. Any amount already paid for a cancelled order will be refunded.

5. Payment

Payment is due in full when the order is placed.

Available payment methods are those displayed during checkout and may include payment by card, Apple Pay and Google Pay through the payment services available on the website.

Payment transactions are processed through secure third-party payment providers. MIX A L'EAU DE MER does not store customers' complete payment card details.

6. Manufacturing and delivery

Yves Jaget microphones are handcrafted in small batches.

Unless otherwise stated on the relevant product page, the usual manufacturing time is approximately:

2–3 weeks

Once the order is ready and dispatched, the usual estimated shipping time is:

5–10 working days

The applicable delivery information and shipping charges are shown to the customer before the order is confirmed.

Orders are delivered to the address supplied by the customer during checkout. The customer is responsible for ensuring that the information provided is accurate and complete.

If circumstances affect the announced delivery period, the customer will be informed as soon as reasonably possible. Consumer customers retain all rights relating to delivery periods provided by applicable consumer law.

7. Delivery and transport

Products are packaged with care and shipped using an appropriate delivery service.

Where available, tracking information will be provided to the customer after dispatch.

For consumer sales, the risk of loss or damage remains with the seller until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, except where the customer independently commissions a carrier not proposed by the seller.

If a parcel arrives visibly damaged, the customer is encouraged to document the condition of the parcel and contact MIX A L'EAU DE MER promptly at yj@mixaleaudemer.com. This does not affect the customer's statutory rights.

8. Right of withdrawal — consumers

This section applies to customers acting as consumers.

Consumers have the right to withdraw from a distance purchase without giving any reason within 14 days from the date on which they, or a third party designated by them other than the carrier, receive the product.

To exercise this right, the consumer must inform MIX A L'EAU DE MER of the decision to withdraw by an unambiguous statement before the withdrawal period expires.

The request may be sent to:

yj@mixaleaudemer.com

or by post to:

MIX A L'EAU DE MER
1 chemin de Chemoulin
44600 Saint-Nazaire
France

The model withdrawal form provided at the end of these Terms & Conditions may be used, but its use is not mandatory.

After notifying MIX A L'EAU DE MER of the withdrawal, the consumer must return the product without undue delay and no later than 14 days after communicating the decision to withdraw.

MIX A L'EAU DE MER will bear the cost of the return shipment. Return arrangements should therefore be agreed with us before the product is sent.

The consumer may be held responsible for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

9. Refund following withdrawal

Following a valid withdrawal, MIX A L'EAU DE MER will reimburse the payments received from the consumer, including the cost of the standard delivery method offered for the original order, in accordance with applicable law.

Additional costs resulting from the consumer expressly choosing a more expensive delivery method than the standard delivery offered are not refundable beyond the cost of that standard delivery.

The refund will be made using the same payment method used for the original transaction unless expressly agreed otherwise.

The refund may be withheld until the returned product has been received or until the consumer provides evidence that it has been sent back, whichever occurs first.

10. Exceptions to the right of withdrawal

The statutory right of withdrawal does not apply where an exception provided by applicable law applies, including, where relevant, goods made to the consumer's specifications or clearly personalised.

The fact that a standard Yves Jaget microphone is handcrafted or manufactured after an order is placed does not, by itself, remove the consumer's statutory right of withdrawal.

Where a product is genuinely made to a customer's individual specifications or clearly personalised and the statutory withdrawal right therefore does not apply, this will be clearly stated before the order is placed.

11. Legal guarantees — consumers

Consumer customers benefit from the mandatory legal guarantees provided by applicable law.

In particular, under French law, the seller is liable for defects covered by the legal guarantee of conformity under Articles L.217-3 and following of the French Consumer Code.

For new goods, the consumer may invoke this guarantee for defects of conformity appearing within two years from delivery, subject to the conditions provided by law.

Depending on the circumstances and the applicable legal provisions, the consumer may be entitled to repair or replacement of the product, or, where the statutory conditions are met, a reduction in price or termination of the contract.

The customer also benefits from the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code.

These statutory guarantees apply independently of any commercial warranty.

No additional commercial warranty is currently offered by MIX A L'EAU DE MER. This does not limit or exclude any statutory guarantee or right available to the customer.

Claims relating to legal guarantees may be addressed to:

yj@mixaleaudemer.com

12. Professional customers

Customers purchasing products for purposes falling within their professional activity are considered professional customers.

Consumer-specific rights, including the consumer right of withdrawal and consumer mediation provisions, apply only where the customer qualifies as a consumer under applicable law.

For professional customers, payment is due in full at the time of ordering through the website unless different terms have been expressly agreed in writing beforehand.

No discount is granted for early payment unless expressly agreed.

Where legally applicable to a professional customer, late payment may give rise to statutory late-payment interest and the fixed recovery-cost indemnity provided by French commercial law.

Nothing in these Terms & Conditions excludes liability where such exclusion would be prohibited by applicable law.

13. Intellectual property

The Yves Jaget name, branding, product designs, photographs, texts, graphics and other content appearing on the website are protected by applicable intellectual-property rights.

No content from the website may be reproduced, distributed or used commercially without prior authorisation, except where permitted by law.

15. Consumer mediation

Before requesting mediation, the consumer must first contact MIX A L'EAU DE MER in an attempt to resolve the dispute directly.

If no satisfactory solution is reached, the consumer may use the consumer mediation procedure free of charge.

MIX A L'EAU DE MER has appointed:

CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice

Website: www.cm2c.net

The CM2C affiliation of MIX A L'EAU DE MER is valid until 2 October 2029. attestation_adhesion_8128775200…

The consumer may contact CM2C in accordance with the procedure and eligibility conditions published by CM2C.

16. Applicable law and disputes

These Terms & Conditions and contracts concluded through the website are governed by French law.

For consumers, this choice of law does not deprive them of any mandatory protection granted by the law of the country in which they habitually reside where such protection is applicable.

Consumers may use the mediation procedure described above before pursuing other available remedies.

For disputes between MIX A L'EAU DE MER and professional customers, the competent courts will be determined in accordance with the applicable rules of jurisdiction, subject to any valid jurisdiction agreement concluded between the parties.

17. Changes to these Terms & Conditions

MIX A L'EAU DE MER may update these Terms & Conditions when necessary.

The Terms & Conditions applicable to an order are those made available to the customer at the time the order is placed.
